Who provides the service

The services are provided by John Nyale, trading as JamboJohn, a guide and organiser based in Watamu, Kilifi County, Kenya. Transport, accommodation and park entries are bought from authorised local suppliers, named in the written proposal whenever they shape the experience.

How an agreement comes about

The most important point to put down in black and white is also the simplest: the site does not sell anything by itself. The form and the messages exist in order to make an enquiry. The agreement exists only when a written confirmation arrives setting out availability, itinerary, price, conditions and payment terms, and when that confirmation is accepted.

Before that moment no place is held, no price is binding and no date is reserved. This sentence should be kept in the final version too, because it describes how things really work.

What the written proposal contains

  1. Subject matter: which services are provided directly and which are arranged through third parties, with the exact role taken on in each case.
  2. Prices, currency, payment methods and timing, and how any variations due to park or property tariffs are handled.
  3. Obligations of those taking part: valid documents, health conditions relevant to the activity, compliance with park rules and with the instructions given.
  4. Changes to the programme for reasons of safety, weather, sea conditions or decisions by the park authorities.
  5. Limits of liability, distinguishing between what is under direct control and what depends on third-party suppliers.
  6. Travel insurance: whether it is recommended or required, and with what minimum cover.
  7. Governing law, jurisdiction and how disputes are resolved, bearing in mind that the purchaser may be located in the European Union.
  8. Complaints: who to write to, within what time a reply is given, how a failure of service is documented.

The conditions that apply to your experience — price, what it covers, timings, minimum number of participants, payment and cancellation terms — are the ones set out in the written proposal you receive before confirming. That document is what counts: if something doesn't add up, ask me before confirming rather than afterwards.
